Can I abandon sajdah as-sahw as result of an excuse?

The Details of the Question

- I make a mistake almost every day by starting to read Allahumma salli and barik supplications after at-tahiyyat in the first sitting of four-rakah prayers, as if I am performing the first four-rak’ah sunnahs of the afternoon and night prayers. Then, I remember and stand up. Thus, I delay wajib and it becomes necessary for me to perform sajdah as-sahw (prostration of forgetfulness). It always happens to me.
1. How can I get rid of it?
2. Can this state be regarded as an excuse like a wound that continuously bleeds for abandoning sajdah as-sahw?
3. If it can be regarded as an excuse, is it permissible for me to abandon sajdah as-sahw when I lead a prayer as an imam?

The Answer

Dear Brother / Sister,

It is wajib to perform sajdah as-sahw in prayer when a rukn (part) is delayed or repeated and when a wajib is abandoned or delayed by mistake (by forgetting).

If a person says “Allahumma salli ala Muhammad” in the first sitting of a three or four-rak’ah fard prayer after reading at-tahiyyat, he has to make sajdah as-sahw since he delays qiyam (standing), which is fard, according to Abu Hanifa; his prayer becomes complete when he performs sajdah as-sahw. According to Imam Abu Yusuf and Imam Muhammad, sajdah as-sahw is not necessary. (Qasani, Badai, 1/164)

Accordingly, a person who says “Allahumma salli ala Muhammad” in the first sitting of a three or four-rak’ah fard prayer after reading at-tahiyyat and who does it very often can act based on the fatwa of Imam Abu Yusuf and Imam Muhammad and perform and lead prayers without sajdah as-sahw.
