Is it permissible to eat the flesh of horse or donkey?

The Answer

Dear Brother / Sister,

The flesh of horse, donkey and mule: It is haram to eat the flesh of horse and mule in all madhhabs.

The following is narrated from Jabir:

"The Messenger of Allah (pbuh) prohibited us from eating the flesh of donkey but allowed us to eat the flesh of horse." (Bukhari, Dhabaih, 28; Maghazi, 38, Nikah, 21; Muslim, Nikah, 30; Sayd, 23, 25, 30, 37)

Acting upon the hadith above, the two Hanafi imams Abu Yusuf and Imam Muhammad, Hanbali İmam Ahmed b. Hanbal and the majority of Islamic fiqh scholars regard eating the flesh of horse as halal but Abu Hanifa regards it makruh tahrimi.

Imam Malik regards eating the flesh of horse haram acting upon the following hadith:

"The Messenger of Allah prohibited eating the flesh of horse, mule and donkey, and all of the wild animals that have molar teeth." (Ahmad b. Hanbal, I, 147, 244, 289; IV, 89, 90, 127)

Another reason why Abu Hanifa and Imam Malik does not regard eating the flesh of horse halal is the following verse: 

"And (He has created) horses, mules, and donkeys, for you to ride and use for show." (an-Nahl, 16/8)
