Is it written in the Torah and Gospel that a person who kills someone is condemned to death?

The Answer

Dear Brother / Sister,

The following is stated in the Quran regarding the issue:

"We ordained therein (in the Torah) for them: "Life for life, eye for eye, nose or nose, ear for ear, tooth for tooth, and wounds equal for equal." But if any one remits the retaliation by way of charity, it is an act of atonement for himself. And if any fail to judge by (the light of) what Allah hath revealed, they are (No better than) wrong-doers." (al-Maida, 5/45)

The following is stated in the Torah for the decree of qisas (retaliation):

Lev.24:17 Exo.21:12 «Anyone who takes the life of a human being is to be put to death.

Lev.24:18 Anyone who takes the life of someone’s animal must make restitution—life for life.

Lev.24:19 Anyone who injures their neighbor is to be injured in the same manner.

Lev.24:20 Exo.21:23-25; Deu.19:21; Mat.5:38 Fracture for fracture, eye for eye, tooth for tooth. The one who has inflicted the injury must suffer the same injury.

Lev.24:21 Whoever kills an animal must make restitution, but whoever kills a human being is to be put to death.

Lev.24:22 Num.15:16 You are to have the same law for the foreigner and the native-born. I am the Lord your God.»

The approach of the Gospel related to retaliation and revenge is quite different from the Torah and the Quran.

Matthew / Chapter 5:

38. You have heard that it was said, ‘Eye for eye, and tooth for tooth.‘

39. But I tell you, do not resist an evil person. If anyone slaps you on the right cheek, turn to them the other cheek also.

40. And if anyone wants to sue you and take your shirt, hand over your coat as well.

43. You have heard that it was said, ‘Love your neighbor and hate your enemy. ‘

44. But I tell you, love your enemies and pray for those who persecute you.

Luke / Chapter 6:

27.-28. But to you who are listening I say: Love your enemies, do good to those who hate you, bless those who curse you, pray for those who mistreat you.

29. If someone slaps you on one cheek, turn to them the other also. If someone takes your coat, do not withhold your shirt from them.

30. Give to everyone who asks you, and if anyone takes what belongs to you, do not demand it back.

31. Do to others as you would have them do to you.

32. If you love those who love you, what credit is that to you? Even sinners love those who love them.

33. And if you do good to those who are good to you, what credit is that to you? Even sinners do that.

34. And if you lend to those from whom you expect repayment, what credit is that to you? Even sinners lend to sinners, expecting to be repaid in full.

35. But love your enemies, do good to them, and lend to them without expecting to get anything back. Then your reward will be great, and you will be children of the Most High, because he is kind to the ungrateful and wicked.

36. Be merciful, just as your Father is merciful.
